1. About these terms

Welcome to GlossBeau. glossbeau.com is operated by Beauty Innovation LLC ("GlossBeau," "we," "us," or "our"). These Terms of Service ("Terms") apply when you browse the site, create an account, or buy from us (the "Services"). By using the Services, you agree to these Terms and our Privacy Policy. If you don't agree, please don't use the Services.

2. Eligibility and accounts

You must be at least 18, or the age of majority where you live, to place an order. You agree to give us accurate, current information and to keep it up to date. You're responsible for keeping your account login secure and for activity on your account.

3. Products and product use

• We sell authentic professional products sourced from brands and their authorized distributors.
• Product photos and colors may look different on your screen than in person, especially nail and hair colors.
• Some products, such as hair color, developers, chemical treatments, and keratin treatments, are made for professional use. Always read and follow the manufacturer's directions and warnings. For hair color, do a patch test 48 hours before each use. If you are unsure whether a product is right for you, consult a licensed professional.
• We may change product descriptions, discontinue products, or limit quantities at any time.

4. Pro pricing

Pro pricing is available to licensed cosmetologists, barbers, nail technicians, estheticians, and salon owners. To get it, you must apply and give a valid professional license. We may verify your license with the issuing state board, ask for updated proof, and remove pro pricing if a license can't be verified or has expired. Pro pricing is for your own professional use and may not be shared.

5. Orders

When you place an order, you're making an offer to buy. We may accept, decline, limit, or cancel any order, including orders that appear fraudulent or for resale. Your order is accepted only when we confirm it. If we cancel an order after you've paid, we'll refund you in full. Products you buy are for your personal or professional use, not for resale.

6. Prices and payment

Prices are in U.S. dollars and may change without notice. You pay the price shown when you place your order. Prices don't include taxes or shipping unless stated. If a product is listed at the wrong price because of an error, we may cancel the order and refund you, even after it's confirmed. You confirm that you're authorized to use the payment method you give us.

7. Shipping and returns

Shipping is covered by our Shipping Policy, and returns and refunds by our Return & Refund Policy. Delivery times are estimates. Once we hand your order to the carrier, the risk of loss passes to you, but we'll always help you with a lost or damaged package claim.

8. Intellectual property

The GlossBeau name, logo, site design, text, and photos created by us belong to Beauty Innovation LLC. Brand names, logos, and product images of the brands we carry belong to their owners and are used with permission or as authorized retailers. You may use the site for personal, non-commercial shopping only. You may not copy, scrape, or reuse its content without our written permission.

9. Reviews and feedback

If you send us reviews, photos, ideas, or other feedback, you allow us to use, edit, and publish them for any purpose, without payment to you. Your content must be honest, must belong to you, and must not be illegal, offensive, or harmful to others. We may remove any content at our discretion.

10. Prohibited uses

You may not use the Services to break the law, commit fraud, harass anyone, upload malicious code, interfere with the site's security, or use bots, scrapers, or automated tools to access the site or buy products without our permission. We may suspend or close accounts that break these Terms.

11. Our relationship with Shopify

Our store is powered by Shopify. Purchases you make are made directly with Beauty Innovation LLC, not with Shopify. Shopify is not responsible for any part of your purchase, and you release Shopify and its affiliates from all claims related to your purchases from us.

12. Disclaimers

Except as stated in these Terms or required by law, the Services and products are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Manufacturer warranties on tools still apply. Some states don't allow these disclaimers, so they may not apply to you.

13. Limitation of liability

To the fullest extent allowed by law, GlossBeau, Beauty Innovation LLC, and Shopify are not liable for indirect, incidental, special, or consequential damages, or for lost profits, arising from your use of the Services or products. Our total liability for any claim will not exceed the amount you paid for the products involved.

14. Indemnification

You agree to defend and hold harmless GlossBeau, Beauty Innovation LLC, Shopify, and their affiliates and employees from claims caused by your breaking these Terms or the law, or by your misuse of the Services or products.

15. Governing law

These Terms are governed by the laws of the State of Louisiana, United States. Any dispute will be handled in the state or federal courts located in Jefferson Parish, Louisiana, unless the law where you live requires otherwise.

16. General

If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce a right is not a waiver of it. These Terms and the policies they mention are the full agreement between you and us about the Services.

17. Changes

We may update these Terms at any time by posting the new version on this page and changing the "Last updated" date. Continuing to use the Services after an update means you accept it.
